1. Introduction

These Terms and Conditions govern your use of the MachSafe platform and services provided by Mach Global Ltd (company number 16603107), registered in England and Wales, trading as MachSafe ("we", "us", "our").

By accessing or using MachSafe, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. The Service

MachSafe provides a cloud-based SaaS compliance platform designed to assist Accountable Persons and organisations managing higher-risk residential buildings in England with their obligations under the Building Safety Act 2022.

Important limitation: MachSafe is a tool to assist with compliance management. It does not constitute legal advice. All AI-generated outputs, including Safety Case Report drafts, are clearly labelled as drafts requiring human review and professional sign-off before submission to any regulator. You remain solely responsible for ensuring your compliance with the Building Safety Act 2022 and all applicable regulations.

3. Accounts and Access

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised access to your account.
• We may suspend or terminate accounts that violate these Terms.

4. Subscription and Payment

• Subscriptions are charged per building per month at the rates set out on our Pricing page.
• Payment is due monthly in advance by credit or debit card.
• All prices are exclusive of VAT unless stated otherwise.
• We reserve the right to change pricing with 30 days notice.
• Refunds are not provided for partial months of service.

5. Free Trial

Where we offer a free trial period, access is provided at no cost for the stated period. No credit card is required during the trial. At the end of the trial, the service will not automatically convert to a paid subscription unless you choose to upgrade.

6. Acceptable Use

You must not use MachSafe to:

• Upload unlawful, fraudulent, or misleading content
• Attempt to gain unauthorised access to other accounts or systems
• Interfere with the security or integrity of the platform
• Use the platform in any way that violates applicable law
• Reverse engineer or copy any part of the platform

7. Intellectual Property

MachSafe and all associated intellectual property — including the platform, compliance rule engine, AI methodology, and brand — is owned by Mach Global Ltd. You are granted a limited, non-exclusive licence to use the platform during your subscription period.

You retain ownership of all data and documents you upload to MachSafe.

8. AI Features and Limitations

MachSafe's AI features, including the Safety Case Generator and Compliance Checker, are designed to assist human professionals — not replace them. You acknowledge that:

• All AI outputs are drafts requiring review and approval by a competent person before use
• AI outputs may contain errors and should not be submitted to regulators without professional review
• MachSafe makes no warranty that AI-generated Safety Case drafts will be accepted by the Building Safety Regulator
• You are solely responsible for the accuracy and completeness of any submission made to the BSR

9. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, available at machsafe.co.uk/privacy. By using MachSafe, you agree to our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Mach Global Ltd shall not be liable for:

• Any indirect, incidental, or consequential damages arising from use of the platform
• Any regulatory penalties or enforcement action resulting from your compliance decisions
• Any loss of data, business, or profit arising from use or inability to use the platform

Our total liability to you in any 12-month period shall not exceed the total subscription fees paid by you in that period.

11. Termination

Either party may terminate the subscription at any time. Upon termination:

• Your access to the platform will cease at the end of the current billing period
• You may export your data for 30 days following termination
• Your data will be deleted in accordance with our Privacy Policy

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email with 30 days notice. Continued use of the platform after notice constitutes acceptance of the updated Terms.
